General Provisions
- These Terms and Conditions (“Terms”) govern the legal relationship between the User (“User”) and LLC International Finlow Support (ID 406389206) (hereinafter: “AURUM”).
- Use of AURUM means that the User fully agrees to the Terms and undertakes the obligation to comply with them.
- These Terms of Service define access to any service offered by AURUM by any person.
- These Terms apply to all visitors, users, and other persons who register or otherwise gain access to or use the service.
- By accessing or using the Service, registering an account on AURUM and/or clicking the “I Agree to the Terms and Conditions” button, the User electronically confirms that he/she has read, understood, and agrees to the provisions, obligations, and other policy documents placed on AURUM.
- AURUM reserves the right to amend the Terms at any time. Amendments shall take effect immediately upon their publication on the website.
- The User guarantees that he/she is aware of the risks related to virtual assets and their transactions and assumes responsibility for all transactions conducted while using AURUM’s services. The User acknowledges and agrees that all decisions related to transactions are made solely by the User, and AURUM does not bear responsibility and/or assume any obligation for the consequences of such decisions.
- AURUM does not provide any guarantees against undesirable results in virtual asset trading.
Description of the Service
- AURUM provides exchange services of virtual assets into national or foreign currency.
- AURUM is not a bank or a financial institution and does not provide credit or deposit services.
- The User is obliged, when using AURUM, to comply with the legislation of Georgia, rules against money laundering and terrorism financing, as well as all other regulations related to AURUM’s services.
Compliance with Requirements
- The User confirms that he/she is over 18 years old, as the use of AURUM’s products is not permitted for persons under 18.
- The User confirms that he/she will not use AURUM for: purchasing or selling illegal goods and services; money laundering or terrorism financing; transactions with sanctioned persons or organizations; in jurisdictions where the use of AURUM’s services is prohibited.
- AURUM is authorized to request any additional documents or information from the User to satisfy AML/KYC and regulatory requirements, refuse service or suspend/block the User’s account if the User violates legislation, regulations, or internal platform policies, and provide User data to relevant authorities if there is a legal obligation or suspicion of illegal activity.
- The User understands and agrees that AURUM may use third-party services to ensure compliance with requirements.
Registration and Account Opening
- Registration is required for the use of AURUM.
- During registration, the User is obliged to provide accurate and truthful information.
- AURUM reserves the right to request additional information and documents under AML/KYC procedures, which the User must complete prior to a one-time transaction or before establishing a business relationship.
- Only one account is permitted per User.
- AURUM may, at its sole discretion, modify or update the product’s functionality, in whole or in part, at any time.
User Obligations
- The User must not transfer his/her rights to use the service or otherwise alienate any part of the rights granted under these Terms.
- The User is not allowed to copy, distribute, modify, or otherwise use the product interface, except in cases expressly permitted.
- The User must not perform and must not assist third parties in performing unauthorized actions, including using bots, reverse engineering, interfering with servers, damaging systems, using other accounts without permission, and sending spam or unwanted communications.
Transactions
- All transactions are executed based on the instructions given by the User.
- After execution, transactions cannot be canceled or changed.
- AURUM is not responsible for transfers made to incorrectly indicated addresses or accounts by the User.
Fees and Commissions
- Operations carried out on the platform are subject to commission tariffs established by AURUM.
- The commission fees are published on the website, and the User is obliged to familiarize himself/herself with them before conducting any transaction.
Limitation of Liability
- AURUM does not guarantee uninterrupted or error-free functioning of the platform.
- AURUM is not liable for losses caused by third-party actions or technical failures.
- The User is fully responsible for the security of his/her account, password, and authorization data.
Intellectual Property
- All intellectual property of AURUM belongs to LLC International Finlow Support (ID 406389206).
- The User must refrain from copying, distributing, or unlawfully using AURUM.
Processing of Personal Data
- AURUM collects only the data necessary to provide services, comply with AML/KYC requirements, and identify the User.
- Collected data includes: first name, last name, date of birth, nationality; ID document and selfie; contact info; bank account/payment details; IP and device/browser info; transaction history.
- Processing is carried out to manage accounts, comply with AML/KYC, ensure transaction security, prevent fraud, and improve service.
- The User may access information about what personal data is processed, the purpose, legal basis, source, duration, automated processing, disclosures, and grounds for disclosure.
Termination of Account
- The User may terminate the use of the account at any time.
- AURUM reserves the right to terminate the User’s account if there is a violation of the Terms or AML/KYC risks.
Dispute Resolution
- All disputes shall be resolved through negotiation.
- If an agreement cannot be reached, the dispute shall be submitted to the Tbilisi City Court.
